Board Recommendation for Revocation of Neuhaus Medical License February 2012 —
On February 20, 2012 Administrative Law Judge Edward Gaschler recommended the revocation of Drr. Kristin Neuhaus' medical license for the work she did at Dr. Tiller's clinic. The Court's opinion verifies the illegal conduct at Tiller's clinic and presents a small part of the evidence obtained by Attorney General Phill Kline in his investigation of Dr. Tiller. The Kansas Board of Healing Arts brought this action to revoke Dr. Neuhaus' license based on Kline's evidence. the board was also proceeding against Dr. Tiller at the time that he was murdered. Kline's criminal charges against Dr. Tiller were dismissed, ex parte (without notifying Kline) by a Judge who was not assigned the case and who did not review Kline's evidence. The dismissal came at the request of Wichita District Attorney Nola Foulston who claimed Kline as Attorney General did not have jurisdiction to file the charges. Kline appointed a special prosecutor to appeal the dismissal, but his successor, Sebelius recruited abortion supporter Paul Morrison dismissed Kline's appeal and fired the special prosecutor. Tiller never faced Kline's substantive charges.

Dr. Tiller's Greeting to Patients January 2012 —
This audio is taken from Dr. Tiller's video greeting to new patients. At the time, Kansas law only allowed a late-term abortion if the mother's life was in jeopardy or two doctors found the abortion was necessary because the pregnancy "will cause a substantial and irreversible impairment of a major bodily function" of the mother. This audio clearly demonstrates Dr. Tiller considered all justifications for an abortion as presenting "severe and irreversible impairment of a major bodily function."

Dr. Tiller states he has performed more than 10,000 late-term abortions (24-36 weeks gestational age) and 800 involved fetal anomaly. At that time, Dr. Tiller was classified all of his late-term abortions as involving a "severe fetal anomaly." This was necessary for Dr. Tiller to claim these late-term abortions were legal by claiming the Kansas legal exception allowing late-term abortions if the fetus suffered a "severe anomaly. Dr. Tiller's comments are inconsistent with his legal claim that all of his abortions fit that exception.

In January of 2008, Sebelius recruited Attorney General Paul Morrison resigned in scandal. Sebelius appointed Stephen Six to replace Morrison and inherited Morrison's "highly technical" criminal charges against Dr. Tiller. Morrison and Six both refused to reinstate the substantive charges filed against Dr. Tiller by former Attorney General Phill Kline. It is believed that Morrison planned to reach a plea bargain with Tiller which would allow Dr. Tiller to continue his practice. As AG, Six took the Tiller case to court. AG Six, however, entered into an agreement with Dr. Tiller's attorneys that every abortion performed by Dr. Tiller was medically necessary and did not put on any evidence to the contrary. In fact, Six's prosecution team only called one witness - a doctor who worked with Tiller and who testified that the State's charges were not justified - and then the prosecution rested its case. Acquittal was certain and Dr. Tiller's reputation was rehabilitated. Six did not present any of the evidence obtained by Kline which indicated that Dr. Tiller would perform abortions late-term on viable children so that the mother could compete in rodeo or not have to hire a babysitter. Kline had retained one of our nation's leading psychiatrists to review Dr. Tiller's claims that the abortions were necessary for mental health reasons. Dr. Paul McHugh found that every single abortion performed by Tiller was not justified medically or legally. This document is the agreement which General Six reached with Dr.Tiller's attorneys prior to trial.

Foulston Email Regarding Dismissal of Tiller Charges June 2011 —
On December 21, 2006, Attorney General Phill Kline charged Dr. Tiller with violating Kansas late-term abortion restrictions. The charges were filed after District Judge Eric Yost found probable cause to believe that Dr. Tiller committed the crimes Kline alleged. Prior to filing the charges Kline met with long-serving District Attorney and Tiller acquaintance Nola Foulston. Kline informed Foulston of the charges and Foulston stated "I will not stand in your way." She lied. The following day, without notifying Kline, Foulston went to a judge who was not assigned the case and who did not review the evidence, who dismissed the case claiming that Kline as AG did not have jurisdiction to file the case. Kline immediately appealed, but new AG Paul Morrison when he assumed office in January of 2007, fired Kline's Special Prosecutor and dismissed Kline's appeal. This document is the email Foulston sent to Kline after she had obtained the order dismissing the Tiller charges.

Morrison/Six v. Anderson June 2011 —
Former Attorney General Paul Morrison sued District Court Judge Richard Anderson in an effort to return evidence against Planned Parenthood to Planned Parenthood. After General Morrison resigned in December of 2007, Governor Kathleen Sebelius appointed Stephen Six. General Six assumed the Morrison v. Anderson lawsuit and continued to argue that the evidence against Planned Parenthood should be returned to Planned Parenthood. General Six attempted to portray his involvement in this case as passive stating that he was just seeking "guidance" from the Supreme Court. General Six provided this testimony even though he continued the suit after charges were filed against Planned Parenthood, joined with Governor Sebelius to fight the use of other incriminating documents, joined Planned Parenthood in suing the prosecutor District Attorney Phill Kline and sought a secret order to prevent Judge Anderson from presenting the evidence in Kline's criminal case. This document is General Morrison's original Petition against Judge Anderson.

Powerpoint Revealing Sebelius Ties to Abortion Industry June 2011 —
This 64 slide powerpoint was prepared by Mr. Earl Glynn of Kansas Watchdog. The powerpoint reveals some of the ties of former Kansas Governor and now Secretary of Health and Human Services ties to the abortion industry. Planned Parenthood monies, however, are largely not traceable as Kansas law allows for unlimited coordinated independent expenditures in support of a candidate. Planned Parenthood was the primary funding source for an award-winning phone banking and direct mail campaign which falsely portrayed AG Kline's investigation as a fishing expedition and a threat to everyone's medical records. Planned Parenthood stands to lose more than $350 million of annual federal funding if convicted on Kline's charges.

Investigative File - Planned Parenthood Fails to Report Child Rape June 2011 —
In this May 26, 2004 Affidavit, Special Agent Thomas Williams of the Office of Kansas Attorney General Phill Kline reveals the results of Kline's multi-month effort to get the Sebelius Administration to release to law enforcement records relating to the failure to report child abuse. The Affidavit is filed in Kline's investigation of Planned Parenthood and was used to obtain a subpoena of redacted Planned Parenthood records. On page 2 in the last two sentences of paragraph 3, Agent Williams reveals that during a time when more than 166 abortions were performed on underage children in Kansas that Kansas abortion providers only reported 4 instances of child rape. Page 5 of the document (bates stamped pg. 298) reveals that of the reports, only one came from Dr. George Tiller and only one from Planned Parenthood - the two clinics who performed almost all of the underage abortions. Actions by the Sebelius appointed Kansas Supreme Court and Sebelius recruited AG Morrison and Sebelius appointed AG Six prevented Kline from filing charges based on this evidence although non-reporting was later confirmed by other sources.

Anderson Supplements His Response June 2011 —
Judge Anderson filed a supplemental response on October 19, 2007 in which he points out that AG Morrison continued to misrepresent the nature of the documents at issue. General Six continued this litigation and made the same arguments forwarded by General Morrison. General Six also continues the misrepresentations, claiming before the Senate Judiciary Committee that falsely claiming that the documents were "sensitive" and contained patient identities.

Anderson Responds to Morrison/Six Lawsuit June 2011 —
Former AG Paul Morrison sued Judge Richard Anderson in Mandamus before the Kansas Supreme Court. Morrison's lawsuit sought an order for Judge Anderson to return the files subpoenaed from Planned Parenthood to Planned Parenthood. When appointed by Sebelius in February of 2008, General Six continued this lawsuit even after District Attorney Kline filed charges against Planned Parenthood based on the records in Judge Anderson's possession. General Six even sought an order that Judge Anderson not be able to produce the records in Kline's criminal case and joined Planned Parenthood in suing Kline. This is Judge Anderson's response to AG Morrison's original Petition. In this document Judge Anderson states that AG Morrison misrepresents the documents, that the documents contain evidence of potential crimes and that patient privacy has been protected. AG Six, in his Senate testimony, continues some of the misrepresentations about which Judge Anderson complains.

Order Silencing Key Witness June 2011 —
In 2004, based on evidence presented by former Kansas Attorney General Phill Kline, Shawnee County District Court Judge Richard Anderson subpoenaed medical records from Planned Parenthood. The records, redacted of all patient identities, were provided to Judge Anderson in late 2006. In November AG Phill Kline was defeated by Kathleen Sebelius recruited Paul Morrison who pledged to end Kline's investigation of Planned Parenthood. In December 2006, Kline was elected to replace the resigning Paul Morrison as Johnson County District Attorney. Accordingly, in January of 2007, the men switched jobs. Kline continued his investigation as District Attorney. In June of 2007, AG Morrison joined Planned Parenthood in suing Kline attempting to remove all evidence from Kline's possession. Later, Morrison sued Judge Anderson who maintained the original documents produced by Planned Parenthood. Both Kline and Anderson vigorously defended the use of the evidence. In October 2007, based on Kline's evidence, Judge James Vano found probable cause to believe Planned Parenthood committed 107 criminal acts. In December of 2007, General Morrison resigns in scandal. In January 2008, Judge Anderson testified that it appeared Planned Parenthood committed felonies to cover up misdemeanors and that the records contained "evidence of crimes which need to be evaluated. On February 1, 2008, Governor Sebelius appoints Stephen Six Attorney General to replace Morrison. Six then, without notifying Kline, obtains an order from the Kansas Supreme Court that the records in Anderson's possession cannot be used in the case against Planned Parenthood. A majority of the Justices on the Court have been appointed by Sebelius. This document is that order. When Kline learned of the order he appealed it back to the Supreme Court which issued the order. In October of 2010, the Court reversed itself and will now allow Anderson to testify.

Six Silences Key Witness Against Planned Parenthood June 2011 —
Within weeks of Judge Richard Anderson testifying that it appeared Planned Parenthood committed felonies to cover-up misdemeanors and that Planned Parenthood documents appear to be manufactured, General Six sought and obtained a secret order from the Kansas Supreme Court to prevent Judge Anderson from allowing the evidence against Planned Parenthood from being used in the criminal case against Planned Parenthood. This is General Six's motion. Two years later the Supreme Court reversed itself and is now allowing Anderson to testify.
In his Senate testimony General Six portrays his efforts as passive stating that the matter was "referred to the Kansas Supreme Court" and that it was necessary to provide Judge Anderson counsel because "he was sued." General Six fails to mention that he was the party suing Judge Anderson for the purpose of removing from the Judge all evidence against Planned Parenthood. The matter was not "referred" to the Kansas Supreme Court but rather it was General Six who sued in the Kansas Supreme Court. Furthermore, General Six fails to mention that he sought an order silencing Judge Anderson. -

A summary of some of the deceptive testimony offered by former Kansas Attorney General Stephen Six in support of his nomination to the 10th Circuit Court of Appeals. In testimony Six falsely claims his meddling in the prosecution of Planned Parenthood was primarily for the purpose of protecting "sensitive" records and to ensure that patient identities were redacted. The truth, however, is far different. The records used in the prosecution of Planned Parenthood were redacted of patient identities long before Six was appointed to be Attorney General by former Kansas Governor Kathleen Sebelius. Also, Six sued a sitting Judge and former Attorney General Johnson County District Attorney Phill Kline seeking orders that all evidence against Planned Parenthood be returned to Planned Parenthood. Six's efforts were designed to end the only criminal case ever against Planned Parenthood.

Investigative Report - Child Rape Unreported in Kansas

This is the report of Phill Kline's investigator Thomas Williams which shows that child rape was going unreported in Kansas as far back as 2002 and 2003. At the time, Mr. Williams, who previously served as an FBI agent for 20 years, was leading Mr. Kline's investigation of the Kansas abortion clinics for failure to report child rape. Mr. Williams had finally obtained information from the state agencies overseen by then Governor Kathleen Sebelius after months of legal wrangling. The Sebelius administration resisted these disclosures.
You will see the incriminating evidence on page 2 of Mr. William's affidavit at the end of paragraph 3. The report reads that during a time when 166 abortions were performed on underage children in Kansas (ages 10-14) Planned Parenthood and Dr. George Tiller each only reported one case of child rape.
On this basis Shawnee County District Court Judge Richard Anderson found probable cause to believe that evidence of criminal activity was present in the abortion records of Tiller and Planned Parenthood and Anderson subpoenaed the records.
The Sebelius appointed Supreme Court intervened and held up the investigation for more than two years. Furthermore, the Sebelius Court ordered the clinics to turn over the records Kline sought, but allowed the abortion clinics to remove the names of the children. The Court told Kline he could go back and seek the names of the children after he reviewed the records. The records, however, were not turned over until October of 2006. In November, Kline lost his re-election to Paul Morrison, a Sebelius recruited candidate, who benefited from millions of dollars of abortion industry monies.
Kline did not have time to go back and get the children's names and Mr. Morrison ended this phase of the investigation. As a result, the state never took action to protect these unnamed children and Planned Parenthood and Dr. Tiller evaded charges on this evidence. -
